I am writing on behalf of onPeak LLC (“onPeak”) and Association Name with respect to your recent communication addressed to Association Name and its conference Attendees.
It has been brought to the attention of both onPeak and Association Name that you have been promoting, marketing, advertising and selling services to the Association Name customers in connection with the Association Name Show in City via emails, phone calls and other distribution channels [WOULD CONSIDER INCLUDING SITUATION SPECIFIC THINGS LIKE WEBSITE AND INCLUDE A LINK].
As you know, you are not authorized to solicit those parties registered for the Association Name Show.
The Association Name owns the Event Name, including all related intellectual property rights, and has the sole and exclusive right to market, promote, advertise and sell all services and products related to the Event Name. Even if you provide a disclaimer that you are not affiliated with the Association Name that does not excuse you from liability associated with the intentional interference with Association Name business and its customer relations. Furthermore, your actions have consequently deprived the Association Name the benefit of goodwill attached to Event Name, including trademarks, events and services and have caused the Association Name potential economic harm and exposed the Association Name to liability due to your tortuous interference with existing contractual obligations.
To resolve this matter, Association Name requests that you and any other party associated with you or your company immediately refrain from using and promoting marketing, advertising and selling your services to Association Name customers and potential customers in any way related to Association Name services or Event Name.
You should also be aware, that the Association Name has longstanding relationships with many of the hotels for which you are offering reservations. If you refuse to respond to this correspondence in a timely manner, we will notify each of the hotels of your unauthorized use of the Association Name, Event Name and customer lists and request that they review all reservations obtained through your organization.
Please respond in writing by no later than Day, Date, Year confirming that you will comply with the above request. Should you not comply with the request, we will not hesitate to pursue and any all legal remedies available to Association Name to prevent the use of the Event Name, which will include a notification to the United States Federal Trade Commission.
